Return of the Nomination Filibusters?

Not judicial nominations, but the nomination of Peter Cyril Wyche Flory to be an Assistant Secretary of Defense was held up on the floor of the Senate on a 52-41 cloture vote. Had the vote been on confirmation, the same 52 votes would have resulted in confirmation.

Nary a peep from Senator Frist. Nary a peep.

In the same vein, I note too that Dorrance Smith was confirmed with fewer than 60 votes. Although that can be rationalized by the fact that 3 GOP members were absent, not voting (Brownback, Roberts, and Stevens), AND there were 7 DEM crossovers (Feingold, Kohl, Landrieu, Lieberman, Lincoln, Nelson (NE), and Pryor) indicating that Smith had cloture-busting supermajority support.
